These Terms of Service (“Terms”) govern your access to and use of our website, https://www.link.ai, and any related services provided by Link Management Systems Inc. (“Link”, “we”, “us”, or “our”). By using this website or engaging with any of our services, you agree to be bound by these Terms. If you do not agree, you must discontinue all use of our website and services immediately. “Affiliates” refers to our associated entities including Link Brokerages, First Link Mortgage, and Linked Escrow, each of which is operated under Link Management Systems Inc. “Agents” include licensed professionals and independent contractors who may provide real estate services under one of our brands. These individuals are not employees of Link Management Systems Inc. unless explicitly stated. These Terms do not apply to your interactions with Agents outside of this website. For such interactions, additional or separate terms may apply.

PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE A MANDATORY ARBITRATION CLAUSE AND CLASS ACTION WAIVER (SEE SECTIONS 15 AND 16).

1. Acceptance of Terms of Service
By accessing, browsing, or registering on https://www.link.ai (the “Site”), or by using any of the services, tools, or features offered by Link Management Systems Inc. (“Link”, “we”, “us”, or “our”), including services provided through its subsidiaries and affiliates Link Brokerages, First Link Mortgage, and Linked Escrow, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). These Terms apply to all users of the Site, whether you are visiting the Site as a guest or registered user, and govern your use of any content, tools, or services made available on or through the Site. If you do not agree with these Terms, you may not use the Site. If you are accessing the Site on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not have such authority, you may not use the Site or accept these Terms on its behalf.

Link Management Systems Inc. offers a centralized platform for users to access services across real estate brokerage, mortgage financing, and escrow settlement. Through this Site, users may search for properties, request mortgage information, view closing services, and use AI-driven tools to support the real estate transaction process.We serve as a technology and service facilitator. Link does not own any of the properties listed on the Site and does not act as a party in real estate transactions unless otherwise stated. Users are encouraged to conduct their own due diligence, including consulting licensed professionals, reviewing contracts carefully, and verifying the condition and details of any property prior to proceeding with a transaction.

4. Registration
To access certain tools and services—such as saving property searches, applying for a mortgage, or receiving personalized updates—you may be required to create an account (“Account”). You agree to: (Provide accurate, current, and complete registration information; Keep your credentials secure and confidential; Be responsible for all activity that occurs under your Account). You may not create an Account using false information or on behalf of someone else without authorization. If you believe your Account has been compromised, please notify us immediately at contact@link.ai. You may request deletion of your Account at any time by contacting us at the same address.

5. User Responsibilities and Conduct
You agree to use the Site and its services for lawful purposes only. In using the Site, you must not: (Attempt to gain unauthorized access to the Site, its systems, or other users’ accounts; Interfere with the normal operation of the Site or attempt to compromise its security; Use automated scripts, scrapers, or bots without our prior written approval; Reproduce, duplicate, or exploit the Site’s content or design for commercial use without authorization; Provide false or misleading information while using our services; Violation of these rules may result in suspension or termination of your access to the Site and may expose you to civil or criminal liability).

8. MLS Disclosure
This website aggregates data from Multiple Listing Services (MLS), including California Regional Multiple Listing Service (CRMLS), and is intended solely for personal, non-commercial use by consumers. The information is provided to help visitors identify prospective properties for purchase or lease. The content, including property details and images, may originate from the Internet Data Exchange (IDX) program and could include listings from brokerage firms other than the brokerage operating this website. All information displayed is deemed reliable but is not guaranteed and should be independently verified through personal inspection and consultation with qualified professionals. All data on the Site is protected under applicable copyright laws. Any unauthorized reproduction, resale, distribution, or other misuse of the information is strictly prohibited.

9. Limitation of Liability
To the fullest extent permitted by applicable law, Link Management Systems Inc. disclaims any liability for damages of any kind arising out of or related to your use of the Site or its services, including but not limited to: (Direct, indirect, incidental, or consequential damages; Loss of data, revenue, or profits; Errors, inaccuracies, or service interruptions; You understand that use of the Site is at your own risk). 11. Dispute Resolution & Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law rules or principles. You agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any services provided, shall be resolved exclusively through binding individual arbitration. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) and take place in a mutually agreed-upon location or remotely if necessary. Arbitration must be initiated within one (1) year from the date the cause of action arises. This agreement to arbitrate does not preclude either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction located in Delaware, solely to preserve the status quo or prevent irreparable harm. By using the Site and agreeing to these Terms, you consent to the jurisdiction and venue of the state and federal courts located in Delaware for any actions permitted to proceed in court.

12. Service Modification & Termination
We reserve the right, at our sole discretion and without prior notice, to modify, suspend, or discontinue the Site or any service, feature, or functionality offered through it. We may terminate or suspend your access to the Site or services for any reason, including but not limited to violations of these Terms, suspected fraudulent activity, or technical or security concerns.Termination of access does not relieve you of any obligations incurred prior to the termination and does not limit any legal or equitable remedies available to Link.

You acknowledge and agree that Link is not liable for any damages or losses resulting from your access to or use of third-party content.

14. No Warranties
The Site and all services, content, and functionality provided through it are offered on an “as is” and “as available” basis. 15. Arbitration Clause
By agreeing to these Terms, you consent that any and all disputes or claims between you and Link, including disputes involving our affiliates, subsidiaries, employees, contractors, or agents, will be resolved exclusively through binding individual arbitration, not in court. This arbitration will be governed by the Federal Arbitration Act and administered by the AAA. If AAA cannot schedule a hearing within six (6) months, either party may request arbitration through Judicial Arbitration and Mediation Services (JAMS). You acknowledge and agree that you are waiving your right to a jury trial or to participate in a class action lawsuit or class arbitration.

16. Class Action Waiver
To the fullest extent permitted by applicable law, you agree that any claim or dispute under these Terms will be conducted only on an individual basis, and not in a class, consolidated, or representative proceeding.You expressly waive any right to bring a class or collective action, or to participate in one as a member or representative. If this waiver is found unenforceable, then the entirety of Section 15 (Arbitration) shall be null and void as to such claim.

17. AI Use & Limitations
As part of the services offered through the Site, Link may provide access to a large language model (LLM)-powered AI assistant to support real estate-related queries, assist in navigation, or summarize documents and data. You understand and agree that: (The AI system is designed to assist, not replace, licensed professionals; Information provided by the AI is generated automatically and may contain errors, omissions, or inaccuracies; No content provided by the AI constitutes legal, financial, or real estate advice, nor does it replace consultation with a licensed real estate broker, attorney, or mortgage professional). You are solely responsible for verifying any information received through the AI with appropriate professionals before making decisions based on it. Link makes no guarantees about the accuracy or applicability of AI-generated responses and disclaims all liability arising from their use.

18. Severability & Waiver
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

19. Entire Agreement
These Terms, along with our Privacy Policy and any additional legal notices or service-specific agreements posted on the Site, constitute the entire agreement between you and Link concerning your use of the Site. They supersede any prior or contemporaneous agreements, communications, or understandings, whether oral or written, between you and Link.

20. Force Majeure
We are not responsible for any failure or delay in our performance or access to the Site due to circumstances beyond our control, including but not limited to:( Acts of God; Natural disasters; War or terrorism; Government orders or regulations; Internet or utility outages; Labor strikes or shortages; Infrastructure failures). These events shall not constitute a breach of these Terms, and our obligations will be suspended for the duration of the force majeure event.
